Welcome to Just Said Yes. These Terms and Conditions govern your use of our website, justsaidyes.co.za, and the services we provide.

By using our website or placing an order with us, you agree to these Terms and Conditions.

1. About Just Said Yes

Just Said Yes creates, designs, personalises, and hosts wedding websites for engaged couples in South Africa.

Our services include:

  • Standard template wedding websites
  • Bespoke custom wedding websites
  • Monthly website hosting and maintenance

2. Our Services

We currently offer the following services:

Standard Template Wedding Website

  • Once-off design and build fee: R1,900

Bespoke Custom Wedding Website

  • Once-off design and build fee: From R4,500, or as quoted for your project

Monthly Hosting and Maintenance

Hosting includes:

  • Secure website hosting
  • Routine maintenance and software updates
  • Website security monitoring

Unless otherwise agreed, wedding websites remain online until 90 days after the couple’s wedding date, after which they are removed from our hosting platform.

3. Payment Terms

To begin your project:

  • A 50% deposit is required before any work starts.
  • The remaining 50% balance must be paid before your website is published.

Payments are processed securely through PayFast.

Your website will not go live until the final balance has been paid in full.

4. Deposits

The initial 50% deposit secures your booking and allows us to begin planning and creating your website.

Once work has commenced, the deposit is non-refundable, as it covers the time, planning, and resources already invested in your project.

5. Content You Provide

To build your website, we rely on the information and media you provide.

This may include:

  • Names
  • Wedding details
  • Event schedules
  • Love story
  • Photos
  • Videos
  • Accommodation information
  • Registry details
  • Other personalised content

You are responsible for ensuring that all information provided is accurate and up to date.

6. Content Submission Deadlines

To help us deliver your wedding website on time:

  • All required content should be submitted within 14 days of paying your deposit.

If we have not received the required content within 21 days of receiving your deposit:

  • The remaining balance becomes immediately due, regardless of the current stage of the project.
  • Your project may be delayed until the outstanding content has been received.

We are not responsible for delays resulting from incomplete or late content submissions.

7. Your Responsibility for Content

You confirm that you own, or have permission to use, any content you submit to us, including:

  • Photographs
  • Videos
  • Written content
  • Logos
  • Graphics
  • Other media

You agree not to submit any content that:

  • Infringes another person’s copyright or intellectual property rights.
  • Is unlawful, defamatory, offensive, or misleading.
  • Violates the rights of any third party.

If a third party makes a claim relating to content you supplied, you remain responsible for that content.

8. Intellectual Property

Until your project has been paid for in full:

  • All website designs
  • Templates
  • Source code
  • Layouts
  • Graphics created by us
  • Design elements

remain the property of Just Said Yes.

Once your final payment has been received:

  • Ownership of the personalised content created specifically for your wedding website transfers to you. This includes the content you supplied and the customised arrangement of that content for your website.

However:

  • Our website templates
  • Underlying design system
  • Source code
  • Development methods
  • Branding elements
  • Reusable design assets

remain the intellectual property of Just Said Yes and may not be copied, resold, redistributed, or reused without our written permission.

9. Hosting

Your wedding website is hosted by Just Said Yes while your hosting subscription remains active.

Hosting includes routine maintenance and reasonable efforts to keep your website available.

Wedding websites are intended to be temporary and will automatically be taken offline 90 days after your wedding date, unless we agree otherwise in writing.

10. Monthly Hosting

Hosting is billed at R30 per month.

You may cancel your hosting subscription by giving 30 days’ written notice to:

Hosting fees already paid are not refundable for the current billing period.

11. Availability of Services

While we aim to provide reliable services, we cannot guarantee uninterrupted availability at all times.

Scheduled maintenance, technical issues, software updates, or circumstances beyond our control may occasionally affect website availability.

We will make reasonable efforts to restore services as quickly as possible.

12. Third-Party Services

Our services rely on trusted third-party providers, including payment processors, hosting infrastructure, email delivery services, and website tools.

Although we choose reputable providers, we cannot be held responsible for delays, interruptions, or failures caused by third-party services beyond our reasonable control.

This includes, but is not limited to:

  • Hosting providers
  • PayFast
  • Email delivery providers
  • Internet service interruptions
  • Domain registry services

13. Limitation of Liability

Nothing in these Terms limits any rights you have under South African law.

To the fullest extent permitted by law:

  • Just Said Yes will not be liable for indirect, incidental, consequential, or special losses arising from the use of our services.
  • We are not responsible for losses caused by events outside our reasonable control, including failures of third-party services.

Our total liability for any claim relating to a specific service will not exceed the amount you paid us for that particular service.

14. Consumer Rights

Nothing in these Terms excludes or limits any rights you may have under:

  • The Consumer Protection Act, 2008 (CPA)
  • The Electronic Communications and Transactions Act, 2002 (ECTA)
  • Any other applicable South African law

Where these Terms conflict with mandatory legal rights, the applicable law will prevail.

15. Privacy

We collect and process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

By using our services, you acknowledge that your personal information will be processed as described in our Privacy Policy.

16. Changes to Your Project

If you request changes after work has begun, we will advise you if the requested changes affect pricing or delivery timelines before carrying out the additional work.

Additional work outside the agreed project scope may incur additional charges.

17. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, pricing, legal requirements, or business practices.

The latest version will always be published on our website and will include the date it was last updated.

18. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms or our services will first be addressed through good-faith discussions between the parties.
